    Super Bowl Fine Nixed In Appeals Case

    One involving a certain 'wardrobe malfunction'


    The U.S. Circuit Court of Appeals overturned a $550,000 indecency fine against CBS Corp. today, saying the Federal Communications Commission "acted arbitrarily and capriciously" in response to 2004's breast-baring Super Bowl halftime show. You know, the one involving Justin Timberlake and Janet Jackson.

    "Like any agency, the FCC may change its policies without judicial second-guessing," the court explained in a statement. "But it cannot change a well-established course of action without supplying notice of and a reasoned explanation for its policy departure."
